1. Agreement to Terms

By purchasing the Relational Behavioral Interpretation Guide or related services from Pivot Transformation ("we," "us," "our"), you ("you," "your," "Client") agree to be bound by these Terms of Service. If you do not agree to these terms, do not purchase or use our services.

2. Services Offered

We offer behavioral interpretation services based on the Maxwell DISC Personality Indicator framework, including:

  • Tier 1: Relational Behavioral Interpretation Guide (document only)
  • Tier 2: Guide + 90-minute joint debrief session
  • Tier 3: Two-session relational diagnostic (individual sessions + joint debrief)

All services are delivered digitally unless otherwise specified.

3. Eligibility and Participation Requirements

A. Both Parties Must Participate

Both individuals in the relationship must:

  • Complete the Maxwell DISC Personality Indicator assessment
  • Provide accurate information
  • Participate voluntarily and with genuine intent

B. Exclusions

Our services are not appropriate for:

  • Couples experiencing active abuse, untreated addiction, or severe mental health crises
  • Situations where one party is participating under coercion
  • Individuals seeking clinical therapy, diagnosis, or treatment

If any of the above conditions apply, we reserve the right to decline or terminate service and issue a refund at our discretion.

C. Intake Process and Disclosure Policy

After completing DISC assessments, each partner completes a confidential intake form covering relationship context, current challenges, and goals for the guide. These responses are read by the practitioner to inform how the interpretation is written but are not shared between partners and do not appear in the final guide.

In rare cases where intake responses reveal situations beyond the scope of behavioral interpretation — including active safety concerns, significant undisclosed information between partners, or circumstances requiring clinical intervention — we reserve the right to pause production and recommend more appropriate resources. In such cases, a full refund will be issued. This policy exists to ensure you receive services that genuinely fit your situation rather than proceeding with work that would not be helpful.

4. Assessment and Data Accuracy

You agree to:

  • Complete the Maxwell DISC assessment honestly and accurately
  • Understand that the guide is based on the data you provide
  • Accept that the quality of the interpretation depends on the accuracy of your responses

We are not responsible for interpretation errors caused by inaccurate or incomplete assessment data.

5. What Our Services Are (and Are Not)

Our Services Are:

  • Behavioral interpretation based on DISC methodology
  • Structural analysis of relational dynamics
  • Educational and informational in nature

Our Services Are Not:

  • Therapy, counseling, or clinical treatment
  • A substitute for professional mental health services
  • Legal, financial, or medical advice
  • A verdict on whether you should stay together or separate

You acknowledge that this is a clarity tool, not a prescriptive solution.

6. Confidentiality and Privacy

  • We handle your information in accordance with our Privacy Policy
  • Session recordings (if applicable) are provided to you and retained for 90 days unless you request earlier deletion
  • We do not share your assessment data or guide content with third parties except as required for service delivery or by law

Your Responsibility:

You are responsible for how you share, store, or discuss the guide content. We are not liable for breaches of confidentiality that occur after delivery.

7. Payment and Refund Policy

A. Payment

  • Payment is required in full at the time of purchase
  • All prices are in USD unless otherwise stated
  • We accept payment via Credit Card, Debit Card (via Stripe)

B. Refund Policy

  • Before Assessment Completion: Full refund available if both parties have not yet completed the DISC assessment
  • After Assessment Completion: No refunds once both assessments are submitted and guide production has begun
  • Session No-Shows: If you miss a scheduled session without 24-hour notice, the session is forfeited and no refund or rescheduling is provided

C. Rescheduling

Sessions may be rescheduled once with at least 24 hours' notice. Additional rescheduling requests may incur a $50 fee.

8. Intellectual Property

A. Ownership

The Relational Behavioral Interpretation Guide, including its structure, methodology, and written content, is the intellectual property of Pivot Transformation. You are granted a personal, non-transferable license to use the guide for your own relational purposes.

B. Restrictions

You may not:

  • Reproduce, distribute, or sell the guide or any portion of it
  • Use the guide content for commercial purposes
  • Share the guide publicly or post it online without written permission

9. Limitation of Liability

A. No Guarantees

We do not guarantee specific outcomes, relationship improvements, or resolution of conflicts. The guide provides structural clarity — how you apply it is your responsibility.

B. Liability Cap

To the fullest extent permitted by law, our liability is limited to the amount you paid for the service.

C. Excluded Damages

We are not liable for:

  • Emotional distress, relationship deterioration, or personal harm
  • Decisions made based on the guide content
  • Loss of income, opportunity, or other indirect damages

10. User Conduct

You agree to:

  • Engage respectfully during sessions
  • Not record sessions without prior written consent
  • Not misuse or misrepresent the guide content

We reserve the right to terminate service immediately if you engage in abusive, threatening, or inappropriate behavior.

11. Dispute Resolution

A. Governing Law

These Terms are governed by the laws of the State of Texas, United States.

B. Arbitration

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with American Arbitration Association rules.

C. Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class action lawsuits.

12. Modifications to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance.

13. Termination

We may terminate or suspend your access to services at any time if:

  • You violate these Terms
  • You provide false or misleading information
  • We determine the service is not appropriate for your situation

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
